A new amendment to the Basic Medical Coverage Code ensures equal access for children to either parent’s insurance, paternal or maternal. Published in the Official Bulletin, the change updates Article 6 to explicitly allow insured mothers to enroll their children, with the consent of both parents.
The revision concerns the first paragraph of Article 6 of Law 65.00. It provides that «if both spouses are separately insured under this law, the children may be registered with the insurance organization of either the father or the mother, with the consent of both spouses».
This reform ends years of administrative hurdles and unequal access to coverage for children, especially in cases of a father’s death or divorce. It also answers a long-standing demand from women’s rights groups, who argue that allowing children to be covered through their mothers eases the burden on women seeking basic social rights.
The amendment aligns with constitutional principles and Morocco’s international commitments. It stems from Bill 37.25, which amends the first paragraph of Article 6 of Law 65.00: passed by the House of Councillors in November 2020, forwarded to the House of Representatives, and completed its second reading in June 2025. Debate centered on the best interests of the child and the need for stronger health coverage, arguments that helped secure final adoption in July 2025.
