The Barcelona Regional Court has ruled that insurance company Allianz is not required to pay €106,000 in compensation for the disappearance of six trucks reportedly lost in Morocco between August and September 2021, finding that the alleged theft was not sufficiently proven. The court therefore overturned a previous ruling that had ordered Allianz to pay the amount to Fraikin Assets, a vehicle leasing company.
According to court documents, Fraikin Assets reported the disappearance of six trailers it had leased to a transport company, claiming they had gone missing in Morocco. However, the loss was reported in Spain without a formal complaint being filed with Moroccan authorities, a factor the court considered significant in weakening the claim.
During the proceedings, Allianz argued that the compensation request lacked precise details about where and how the trucks disappeared. A private investigator’s report also pointed to a lack of clear evidence of theft: the company that allegedly received the vehicles was not identified, tracking signals were abruptly cut off, and the trucks were never removed from official traffic records, as would normally occur in confirmed theft cases.
Under the ruling, Fraikin Assets will not recover the claimed amount and must bear the legal costs of the initial proceedings. The decision may be appealed within 20 days.
