The High Court of Justice of Andalusia has overturned a decision to expel a Moroccan migrant from Spain and the Schengen Area for three years, citing procedural violations after authorities failed to properly inform her of the legal proceedings.
In a ruling issued in Seville, the court annulled both the judgment of Administrative Court No. 2 and the expulsion order by the Government Delegation. It instructed the administration to re-examine the case and issue a new decision.
The case dates back to when the woman was found working without a permit in Ceuta, leading to an expulsion order that her defense later challenged.
The court criticized the authorities for relying solely on publication in the official gazette to notify her, despite having her address in Morocco. It noted that other channels, such as consular services or local authorities, were not used, thereby violating her right to defense and appeal, as well as fundamental legal and constitutional guarantees.
