Spain's Constitutional Court reviews complaint against Polisario leader

Following the rejection on Friday, May 24, by the Spanish Supreme Court of its complaint against Polisario leader Brahim Ghali, the Sahrawi Association for the Defense of Human Rights (ASADEH) held a videoconference meeting on Wednesday, May 29.

ASADEH plans to appeal the decision. The association's defense intends to file an appeal with the Constitutional Court in Spain in the coming weeks. A favorable verdict from the Constitutional Court could lead the National Court to re-examine the case. If unsuccessful in Spain, ASADEH, a Spanish legal entity, will pursue the case at the European Court of Human Rights.

For the record, the Supreme Court confirmed the decision issued by the National Court in October 2021. The court had then ruled that the facts reported by ASADEH, which occurred between 1974 and 1990, are time-barred according to the 1973 Penal Code.
