Morocco's Ministry of Industry and Trade, along with the Ministry of Economy and Finance, has imposed a definitive anti-dumping duty of 29.93% on Egyptian canned tomato imports for five years, effective December 24, 2024.
The decision follows an investigation initiated on August 7, 2023, prompted by a complaint from the National Federation of Food Industries (FENAGRI), representing three local manufacturers: Conserves de Meknès, Conserves Marocaines Doha, and Traitement de Produits Marocains, which account for 96% of national production.
The Ministry of Industry and Trade's investigation, covering the period from July 1, 2022, to June 30, 2023, revealed that Egyptian imports significantly impacted the domestic market. FENAGRI's April report documented a 14% decline in local production's market share, with price differences between imported and local products increasing from 13% to 35% between 2018 and 2022.
The ministry's investigation found that Egyptian producers did not cooperate during the investigation, leading to the determination of the dumping margin based on available information. The investigation also analyzed trends to determine injury over the period from January 1, 2019, to July 30, 2023. The Customs and Indirect Tax Administration has begun implementing the ruling as per the joint ministerial decision number 2996.24.
The measure applies to products under tariff headings 2002.90.90.11, 2002.90.90.19, 2002.90.90.91, 2002.90.90.99, and 2005.99.35.00. The decision extends the provisional duty previously implemented on May 31, 2024, and includes corresponding VAT charges.
